Gilmer, Texas, July 28, 2016 – Tefteller Law, PLLC has filed a lawsuit in Travis County, Texas State District Court against Martin Marietta Materials, Inc. and TXI Operations, L.P. The lawsuit, which was filed on behalf of Steven and Gaye Dodd, alleges that the Defendants created an unreasonably dangerous condition that jeopardized the safety of those who visited the Hunter Cement Plant in New Braunfels, Texas. According to the lawsuit, the Defendants created such a hazard by improperly welding a steel safety platform that was utilized by truck drivers during loading operations at the plant.
Per the lawsuit, the eighteen wheeler Steven Dodd was operating had just been loaded with cement powder; as he climbed on top of the trailer attempting to close a lid to a silo, he braced himself by pressing against TXI’s steel platform. However, due to the faulty workmanship, a safety rail that had been improperly welded suddenly broke. As a result, Mr. Dodd fell to the ground, suffering severe internal injuries and a traumatic brain injury. Emergency medical service personnel then arrived on the scene. They arranged for Mr. Dodd to be flown via “life flight” to Brackenridge Hospital, Austin, Texas, where he was placed in the intensive care unit.
Companies that disregard safety by creating a dangerous working environment will be held accountable when innocent people get hurt, said Attorney Jarom Tefteller. Businesses that fail to exercise reasonable care in making their property safe will face liability when injuries arise, said Attorney Ron Armstrong, II. While quoting the famous words of an old Texas Supreme Court decision, Attorney Chris Bebel noted that, “if a party negligently creates a situation, then it becomes his duty to do something about it,” so as to insure that others are not harmed.
