PEARL STREET RECONSTRUCTION AND WATER MAIN REPLACEMENT

SEALED PROPOSALS addressed to City of Big Sandy, 100 N. Tyler St., Big Sandy, TX 75755 will be received until 10:00 a.m., Tuesday, March 13, 2012, for furnishing all labor, equipment, materials, supplies, and supervision necessary for constructing approximately 1,800 LF of 6” water mains and related appurtenances and 8,586 SY of asphalt street reconstruction in accordance with the plans and specifications on file at the office of Hayes Engineering, Inc. At the date and time stated, bids will be publicly opened and read aloud at City Hall.

 PLANS AND SPECIFICATIONS may be examined without charge or obtained for $40.00 (nonrefundable) at the office of Hayes Engineering, Inc., 2126 Alpine St., Longview, Texas 75601, (903) 758-2010.

 ALL BID PROPOSALS submitted should be marked clearly on the outside of the sealed envelope with the project name, and bid opening time and date.

 A CERTIFIED OR CASHIER’S CHECK, or an acceptable Bid Bond in an amount not less than five percent (5%) of the total bid shall accompany each bid as a guaranty that, if awarded the contract, the bidder will promptly enter into contract with City of Big Sandy and furnish all required bonds and certificates of insurance on the forms provided.

 THE SUCCESSFUL BIDDER OR BIDDERS will be required to furnish Performance, Payment, and Maintenance Bonds, each in the amount of the contract, written be a responsible surety company authorized to do business in the State of Texas, and satisfactory to the Owner as required by Article 5160 V.A.T.C.S.

 ATTENTION is called to the fact that not less than the federally determined prevailing (Davis-Bacon and Related Acts) wage rate, as issued by the Office of Rural Affairs within the Texas Department of Agriculture and contained in the contract documents, must be paid on this project. In addition, the successful bidder must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex, or national origin.

 BIDDERS SHALL INSPECT the site of the work and inform themselves of all local conditions. Time of completion shall be one hundred twenty (120) calendar days, including Saturdays, Sundays, and legal holidays.

 NO BID may be withdrawn after the scheduled closing time for receipt of bids for at least 60 calendar days after opening of bids, to allow review of bids and investigation of bidder’s qualifications prior to award.

 IN CASE of ambiguity or lack of clearness stating the price in the bids, City of Big Sandy reserves the right to consider the most advantageous construction thereof, or to reject the bid. The Owner reserves the right to reject any or all bids, waive any or all informalities and to award the contract to the bidder or bidders who, in the opinion of City of Big Sandy offers the proposal to the best interest of same.

 ALL CONTRACTORS/SUBCONTRACTORS, which are debarred, suspended or otherwise excluded from or ineligible for participation on Federal Assistance programs may not undertake any activity in part or in full under this project.

REQUEST FOR PROPOSALS FOR THE LEASE OF UPSHUR COUNTY SCHOOL LANDS

The Upshur County Commissioner’s Court is accepting sealed proposals for the lease of 9,847 acres known as the Upshur County School Lands located and being described as “Two leagues of land situated in Throckmorton and Baylor Counties, Texas, granted by the State of Texas to the Commissioner’s Court of Upshur County, by Patent No 772, Vol 12, A567” and 7,865 acres known as the Upshur County School Lands located and being described as ”Two leagues of land situated in Throckmorton County, Texas, granted by the State of Texas to the Commissioner’s Court of Upshur County, by Patent No. 494, Vol 11”. The Upshur County Commissioner’s Court will accept proposals for the lease of one or both tracts.

All proposals should include a copy of the proposed lease. All proposals must include provisions for the lease of the lands for a term of five years beginning and with the first annual payment due June 1, 2012. All proposals should include proposed rental rates per acre per annum or rental rates per acre for the five year term of the lease. Out of date records to be destroyed

The Upshur County Shared Service Arrangement (UCSSA) which is comprised of the Big Sandy, Gilmer, Harmony, New Diana, Union Grove, and Union Hill Independent School Districts, proposes to destroy all out-of-date Special Education records contained in the eligibility folders of students who were dismissed from the program up through July, 2005. Also included in this purging will be records of students who were tested and did not qualify for special education services as well as records of those who qualified but were not placed. These records are presently maintained in the UCSSA office located at 113 West Tyler Street, Gilmer, TX 75644, and include referral information, educational, psychological, medical, admission review and dismissal committee minutes, individual educational plans, and classroom observation data. It is our responsibility to inform you that these records may be needed for social security benefits or other purposes and that it may be to your benefit to obtain them. Upshur County has been awarded $15,178.00 Federal Funds under the Emergency Food and Shelter National Board Program.

 Upshur County has been chosen to receive funds to supplement emergency food and shelter programs in the county.

 The selection was made by a National Board that is chaired by the Federal Emergency Management Agency and consists of representatives from The Salvation Army, American Red Cross, United Jewish Communities, Catholic Charities, USA, National Council of the Churches of Christ in the USA, and United Way of America. The local Board was charged to distribute funds appropriated by Congress to help expand the capacity of food and shelter programs in high-need areas around the country.

 A Local Board will determine how the funds awarded to Upshur County are to be distributed among emergency food and shelter programs run by local service agencies in the area. The Local Board is responsible for recommending agencies to receive these funds and any additional fund available under this phase of the program.

 Under the terms of the grant from the National Board, local agencies chosen to receive funds must; 1) be private voluntary non-profits or units of government, 2) have an accounting system, 3) practice nondiscrimination, 4) have demonstrated the capability to deliver emergency food and/or shelter programs, and 5) if they are private voluntary organizations, they must have a voluntary board. Qualified agencies are urged to apply.

 Persons receiving assistance under this program, if eligible, may only be assisted once within the phase. An application process will be taken on all persons requesting assistance.

This is to give notice that Upshur County has conducted an evaluation as required by Executive Order 11988, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management, to determine the potential effect that its activity in the floodplain will have on the human environment for Texas Community Development Block Grant Program under Small Towns Environment Program (STEP) Contract #710046. The project will provide first-time water service to residents of the Red Rock Community along Locust Road, Highway 80, Juniper Road and Sweet Gum Road in southwest Upshur County. The project will benefit 26 households, of which 71.2% of the occupants are low to moderate income families. The project will involve the installation of water mains in the project area, which will require boring, trenching and other related activities resulting in the temporary disturbance of less than half an acre of floodplain.

Upshur County has evaluated the alternatives to building in the floodplain, and has determined that it has no practicable alternative as the proposed improvements cannot be undertaken in any other location, as relocation costs would exceed available program resources. Failure to provide the improvements would result in continued unsafe and unhealthy living conditions for the 26 families. It is Upshur County’s judgment that Executive Order 11988 has been considered in proceeding with this project for first-time water service, and it has determined that no significant impact will be had upon the floodplain, as a total of less than one-half acre will be temporarily disturbed during the installation process. Environmental files that document compliance with steps 3 through 6 of Executive Order 11988 are available for public inspection, review and copying upon request at the Upshur County Courthouse, 100 West Tyler, Gilmer, Texas between the hours of 9:00a.m. and 4:30 p.m.

Attention City of Gilmer Water Customers

 Due to area drought conditions and with no relief in sight, it becomes necessary to implement “Stage One” of the City’s “Drought Contingency Plan”. The City of Gilmer has been blessed with good quality water and we all need to help protect this precious resource.

 In an effort to conserve water, City staff has reduced non-essential water use; such as, line flushing, the downtown fountain, vehicle washing, and landscape irrigation.

 We now ask that all water customers voluntarily limit the irrigation of landscaped areas to Sundays and Thursdays for customers with a street address ending in an even number (0, 2, 4, 6, or 8), and Saturdays and Wednesdays for water customers with a street address ending in an odd number (1, 3, 5, 7 or 9), and to irrigate landscapes only between the hours of midnight and 10:00 a.m. and 8:00 p.m. to midnight on designated watering days. Water customers are requested to practice water conservation and to minimize or discontinue water use for non-essential purposes.

 If conditions do not improve mandatory restrictions may follow.
