NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS and Final Notice and Public Explanation of a Proposed Activity in a Floodplain & Wetland

On or about March 13, 2017 the City of Gilmer will submit a request to the Texas Department of Agriculture (TDA) for the release of Community Development Block funds under Section 104(f) of Title I of the Housing and Community Development Act of 1974 as amended, to undertake a project known as street improvements, under TxCDBG Contract #7216180. Street Improvements Contractor shall reconstruct streets to improve access and to remove a potential threat to public safety. Contractor shall reconstruct approximately 2,600 linear feet of street utilizing a stabilized base, 2-inch asphalt, gutter, and all associated appurtenances. Construction shall take place in the following locations: East Scott Street from North Cypress to approximately 600 linear feet to the east and North Cypress Street from Highway 154 to Highway 155. The proposed street improvements are located in Gilmer, Texas. Approximately 0.264 acres of the project is located in Zone A of the 100-year floodplain and approximately 0.02 acres are in a wetland. This project will be funded with TxCDBG Grant funds in the amount of $275,000 and $67,475 in other funds. The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA). An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the City Hall,110 Buffalo Street, Gilmer, Texas and may be examined or copied weekdays 8:30 A.M. to 4:30 P.M. FINAL NOTICE AND PUBLIC EXPLANATION OF A PROPOSED ACTIVITY IN A FLOODPLAIN & WETLAND This is to give notice that the City of Gilmer has conducted an evaluation as required by Executive Order 11988 and 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection. The activity is funded under TxCDBG Contract #7216180. The proposed project that will take place is located along East Scott Street from North Cypress approximately 600 linear feet to the east and North Cypress Street from Highway 154 to Highway 155. Contractor shall reconstruct approximately 2,600 linear feet of street utilizing a stabilized base, 2-inch asphalt, gutter, and all associated appurtenances. Approximately .0264 acres of the project is located in Zone A of the 100-year floodplain and approximately 0.02 acres is in a wetland. The City of Gilmer has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values. (i) Reasons why the action must take place in a floodplain and wetland: These street improvements are to replace existing streets which will minimize construction. (ii) Alternatives considered: Constructing additional improvements; but projects would not be economically feasible. No action; but that would cause frequent maintenance issues and poor access, resulting in risks to public safety and welfare, or proceed with the improvements as proposed in a FEMA documented special flood hazard area. (iii) Mitigation measures: None. The City of Gilmer has reevaluated the alternatives to building in the floodplain and wetland and has determined that it has no practicable alternative. In order to provide complete street improvements, the work must be done within the proposed area and not only areas outside the floodplain and wetland. This activity will have no significant impact on the environment for the following reasons: This project will provide a beneficial effect for residents served by the City’s streets by ensuring proper function. The project has been adapted in order to minimize effects on the environment. The few adverse effects caused by construction will be temporary. There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and wetlands and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Commenters are encouraged to offer alternative sites outside of the floodplain and wetland, alternative methods to serve the same project purpose, and methods to minimize and mitigate impacts. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains and wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains and wetlands, it must inform those who may be put at greater or continued risk. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Gilmer. All comments received by March 10, 2017 will be considered by the City of Gilmer prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION The City of Gilmer certifies to TDA that Tim Marshall, Certifying Officer in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. TDA’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Gilmer to use Program funds. OBJECTIONS TO RELEASE OF FUNDS TDA will accept objections to its release of fund and the City of Gilmer certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Gilmer; (b) the City of Gilmer has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by TDA; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to David Brown, Environmental Compliance at the TDA Office of Rural Affairs at P.O. Box 12847, Austin, Texas 78711. Potential objectors should contact TDA to verify the actual last day of the objection period.
