Guilty pleas heard in 115th District Court

Seven guilty pleas and two motions to revoke probation were heard in 115th Court in Gilmer last week.

Eight motions to revoke probation and 10 guilty pleas had been heard April 5 to 9.

Judge Lauren Parish presided.

Pleas heard last week included:

• Tommy Ray McCaskill, 58, College Station, criminal mischief, a state jail felony. He received 17 months in a state jail. Prosecutor was Upshur County District Attorney Billy Byrd, and defense attorneys were Dwight Brannon and Barry Wallace.

• Melanie Rebecca Bell, 38, Gladewater, credit card abuse, a state jail felony. She received six months in a state jail. Byrd was prosecutor, and Scott Novy was defense attorney.

• Reese Albert Wren, 38, Gilmer, arson, a second-degree felony. He got 10 years in prison, probated for six years. He was also ordered to pay $1,000 in restitution to the victim, fined $500, and ordered to perform 800 community service hours. Assistant District Attorney Edward Choy was prosecutor, and Tim Cone was defense attorney.

• Emory Don Pepper, 62, Diana, driving while intoxicated-subsequent offense, a third-degree felony. He received eight years in prison. Byrd was prosecutor, and Craig Bass was defense attorney.

• Jana Gae Hammond, 47, Gladewater, possession of a controlled substance-methamphetamine, a state jail felony. She received 24 months in a state jail. Choy was prosecutor, and Scott Novy was defense attorney.

• Brenda Routh, 49, Gilmer, criminal mischief, county II, a state jail felony. She received nine months in a state jail. Choy was prosecutor, and Barry Wallace was defense attorney.

• Jacob Cole Johnson, 25, Gilmer, theft of property worth between $1,500 and more but less than $20,000, a state jail felony. He received five years deferred adjudication probation. Conditions of probation include a $500 fine and paying $639 in restitution to the victim. He also must peform 300 hours of community service. Byrd was prosecutor, and David Griffith was defense attorney.

Motions to revoke probation for April 12 to 16 included:

• Emory Don Pepper, 62, Diana, driving while intoxicated-subsequent offense, a third-degree felony. He was given an 8-year sentence, to run concurrently with his guilty plea for drunk driving. Byrd was prosecutor, and Craig Bass was defense attorney.

• Eric LaVon Quinn, 40, Gilmer, possession of a controlled substance-marijuana, a state jail felony. He received 18 months in a state jail. Choy was prosecutor, and Cone was defense attorney.

There also was a misdemeanor plea to a charge of possession of marijuana, in which a 26-year-old Ore City man received a year in the Upshur County Jail, probated for two years.

Guilty pleas April 5 to 9 included:

• Harrison Allan Kivela, 18, Gilmer, aggravated sexual assault of a child, a first-degree felony. He received 39 years in prison. Upshur County District Attorney Billy Byrd was prosecutor, and Charles Van Cleef was defense attorney.

• Corey Jimerson, 18, Ore City, aggravated robbery, a first-degree felony. He received 15 years in prison. Assistant District Attorney Edward Choy prosecuted the case, while Scott Novy was defense attorney.

• Alton Ray Easley, 54, Gilmer possession of a controlled substance-heroin, a second-degree felony. He got 20 years in a state jail. Choy was prosecutor, and Dwight Brannon was defense attorney.

• Deborah Lee Murray, 29, White Oak, possession of a controlled substance-Oxycodone, a state jail felony. She received 16 months in a state jail. Choy was prosecutor, and Brannon was defense attorney.

• Jason Scott Roberts, 28, Diana, burglary of a building, a state jail felony. He received 16 1/2 months in a state jail. Byrd was prosecutor, and Novy was defense attorney.

• Ralph Carlos Childers Jr., 47, Gilmer, driving while intoxicated-subsequent offense, a third-degree felony. He got three years in prison. Byrd was prosecutor, and Rick Hurlburt was defense attorney.

• Albert Lawrence Murphy, 54, Gladewater, possession of a controlled substance-cocaine, a state jail felony. He received a 2-year sentence, probated for four years. He was also fined $750 and ordered to perform 400 hours of community service. He also must meet other terms of probation. Murphy also pled guilty to a misdemeanor DWI case. Choy was prosecutor, and Matthew Patton was defense attorney.

• Shanun Lee Shelton, 23, Longview, possession of a controlled substance-methamphetamine, a third-degree felony. He received eight years deferred adjudication probation. Shelton was also fined $1,000 and ordered to perform 600 hours of community service. Choy prosecuted the case, and Craig Bass was defense attorney.

• Anthony Armstong, 39, Big Sandy, securing execution of a document by deception, a state jail felony. He received two years in a state jail, probated for four years. He also was ordered to pay $2,485 in restition and to perform 300 hours of community service. Byrd was prosecutor, and Barry Wallace was defense attorney.

• Kenda Sue Tollkuehn, 46, Longview, forgery, a state jail felony. She received 16 months in a state jail. Choy was prosecutor, and Bass was defense attorney.

• James Franklin Bracey, 34, Gilmer, theft of property worth $1,500 to $20,000, a state jail felony. He got 14 months in a state jail. Choy prosecuted him, while Brannon was his defense attorney.

Motions to revoke probation included:

• Robert L. “Bobby” Ellison, 37, Gilmer and Walker, La., theft between $1,500 and $20,000, a state jail felony. He received nine months in a state jail, after receiving credit for termed served. Byrd prosecuted the case. According to the District Attorney’s Office, Ellison represented himself.

• Steven Ray Fleming, 50, Overton, driving while intoxicated-subsequent offense, a third-degree felony. He received eight years in prison. Choy was prosecutor, and Brannon was defense attorney.

• Travis Lee Story, 23, Gilmer, possession of a controlled substance-methamphetamine, a state jail felony. He received 18 months in a state jail. Choy prosecuted him, and Brannon was his defense attorney.

• James David Mullins II, 25, Hawkins, possession of a controlled substance-cocaine. Choy was prosecutor, and Wallace was defense attorney.

• David Alexander Davis, 29, Simms, burglary of a habitation, a second-degree felony. He received eight years in prison. Choy was prosecutor and Brannon was defense attorney.

• James Franklin Bracey, 34, Gilmer, theft of property worth between $1,500 and $20,000, a state jail felony. Choy was prosecutor and Brannon was defense attorney.

• Leslie Dawn Lee, 38, Longview, driving while intoxicated-subsequent offense, a third-degree felony. She received eight years in prison. DA Byrd was prosecutor, and Kent Phillips was defense attorney.

• John B. Horton, 53, Gilmer, criminal nonsupport, a state jail felony. He got 18 months in a state jail. Byrd was prosecutor, and Wallace was defense attorney.
